Terms of Service — Eloqo

These Terms of Service (“Terms”) govern your use of the Eloqo mobile application (the “App”) provided by Ilia Gordeev (“we”, “us”). By using the App you agree to these Terms and to our Privacy Policy.

1. Eligibility (age)

You must be at least 13 years old to use the App (at least 16 in the European Economic Area, the United Kingdom, and other regions where 16 is the digital-consent age). If you are below the age of majority in your country, you confirm that your parent or legal guardian has reviewed and agreed to these Terms. The App is not intended for children below these ages.

2. The service

Eloqo is a speech-practice coach. It records your voice during exercises and transcribes it and calculates speaking metrics on your device. When you ask for AI feedback, it additionally uses AI analysis to give feedback on your speaking. Feedback is generated automatically and is provided for educational purposes only; it may not be fully accurate and is not professional, medical, or therapeutic advice.

3. Your account

Signing in with Google is optional and enables cloud sync across your devices. You are responsible for keeping your Google account secure. You may sign out at any time, and delete your account and associated data from Settings → Delete account.

4. Voice recording and AI processing

By using the speaking exercises you acknowledge and agree that:

• the App accesses your microphone and records your voice, and transcribes it and calculates metrics on your device;
• when you request AI feedback (which requires signing in), your recording and transcript are sent to our AI provider (Firebase AI / Google) to produce feedback; and
• if you are signed in, your recordings, transcripts, metrics, and progress are stored in your private cloud area to sync across devices.

If you do not sign in, your recordings and practice data stay on your device and are not uploaded to our servers; AI feedback is unavailable until you sign in.

You retain ownership of your recordings. You grant us a limited license to process them solely to provide the App’s features to you, as described in the Privacy Policy.

5. Acceptable use

You agree not to: use the App for unlawful purposes; record other people without their consent where consent is required; upload content that is illegal, infringing, or abusive; or attempt to disrupt, reverse-engineer, or circumvent the security of the service.

6. Subscriptions and payments

The App offers optional paid subscriptions (“Premium”) that unlock additional features. Subscriptions are sold and billed through Google Play and are subject to the Google Play terms.

• Price, billing period (e.g. monthly/annual), and any free-trial terms are shown in the App before purchase.
• Subscriptions renew automatically until cancelled. You can manage or cancel a subscription in your Google Play account settings; cancellation takes effect at the end of the current billing period.
• A free trial, if offered, converts to a paid subscription unless cancelled before it ends.
• Refunds are handled according to Google Play’s refund policy and applicable consumer-protection law.

7. Intellectual property

The App, its content, branding, and software are owned by us or our licensors and are protected by law. These Terms do not grant you any rights to our trademarks or content except as needed to use the App.

8. Disclaimers and limitation of liability

The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law (including your statutory consumer rights).

9. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required by law.

10. Changes

We may update these Terms. Material changes will be communicated in-app and, where required, we will ask you to accept the updated Terms.

11. Governing law and contact
